Prosecutors want the 17-year-old accused in the Halloween-night shooting at a Fairfield Spirit Halloween store to stand trial as an adult. The Solano County District Attorney's Office announced charges on Tuesday, Nov. 3.
The charges
The teen faces two counts of murder with a multiple-murder special circumstance, three counts of attempted murder, three counts of assault with a semiautomatic weapon and several gun enhancements, KCRA 3 reported. The filing also lists a prior conviction for a violent offense as a strike, according to the Daily Republic.
The DA's office said it will argue that he should stay detained, citing "the seriousness of these crimes, the minor's criminal record, and the threat to public safety."
Why a transfer petition
Under Proposition 57, passed in 2016, California prosecutors can no longer file charges against a minor directly in adult court. For a 16- or 17-year-old, they have to file a juvenile petition to transfer, and a judge decides. The DA's office said it filed that petition in this case. The teen is due in Solano County Juvenile Court at 9 a.m. Wednesday, Nov. 4, for an arraignment and detention hearing. A separate hearing will decide whether the case moves to adult court.
The shooting
Police say the suspect walked into the Spirit Halloween store at Solano Town Center on the night of Oct. 30. He allegedly fired at a customer he'd had a previous altercation with, hitting that person and six others in all. Constance Hages, 31, of San Francisco, who was pregnant, was killed. Four of the six wounded were still hospitalized, including a 19-year-old in critical condition. Police have said the teen was previously arrested in a 2025 shooting in a Fairfield high school parking lot, served time and was released.

The Bay Area Brief is not naming the suspect because he is a minor whose case is currently in juvenile court.
