The AP called Prop 37 at 9:06 p.m. Tuesday with Yes at 61%, KQED reported. ABC7 showed 4,605,289 Yes votes to 2,945,686 No.

The Middle Class Homeownership and Family Home Construction Act creates down-payment assistance for families earning up to 200% of their area's median income, adjusted for household size. The aid can only be used for newly built homes, and the revenue bonds are repaid through participating buyers' mortgages. In high-income Bay Area counties, that income cap reaches well into six figures.

Prop 38

Prop 38 led 55.7% to 44.2% in KQED's 2:55 a.m. update, and ABC7 had it at 56% with 4,220,579 Yes votes. The AP had not called it. The bond would fund nonprofit research into immunotherapy for cancer, heart disease and Alzheimer's. Half would go to a specialized immunology institute affiliated with the University of California, chosen by the state Department of Public Health; the other half would be awarded competitively.

All results are unofficial election-night and early-morning counts as of Wednesday, Nov. 4. Counties keep counting mail and provisional ballots for days, and certification comes later, so margins can shift, especially in close contests.
