Oakley's City Council will consider declaring Councilmember George Fuller's District 5 seat vacant at a special meeting Tuesday, Oct. 27, at 5:30 p.m. A proposed resolution says the seat became vacant "by operation of law" on Aug. 19, 2026.

Why it matters: If the council adopts it, District 5 residents would get a new representative, either by appointment or by special election.

The 70-day rule

The resolution cites California Government Code section 36513(b). It says a council seat becomes vacant when a member misses all regular meetings for 70 days in a row without the council's permission.

The city's agenda packet says Fuller missed regular meetings on July 14, Aug. 11 and Sept. 8 without permission. He last attended on June 9, Contra Costa News reported.

City Attorney Derek Cole's report points to California Attorney General opinions involving Bell Gardens in 2017 and Moreno Valley in 2023 as support for the approach.

Background

Fuller was elected in November 2024. The council censured him in October 2025 and took away his committee assignments.

What's next

If the seat is declared vacant, the council's regular 6:30 p.m. meeting that night is expected to take up how to fill it, through an appointment or a special election.
